Trademark owners can extend their trademark’s validity every ten years. Before this period expires, the Registrar provides a six-month grace period for renewal, allowing the trademark holder to maintain their rights. If renewal is not completed within this timeframe, the Registrar will publish a notice of the trademark’s removal in the Trademark Journal.

Trademark Renewal Provision (Section 25)

Under the Trade Marks Act of 1999, a registered trademark can be renewed for an additional ten years after the expiry of its initial registration or most recent renewal. To begin the renewal process, the trademark owner must submit a formal application to the Registrar of Trademarks within the specified timeframe and according to the prescribed guidelines. Upon receiving the application and the required fee, the Registrar will extend the trademark’s registration for another decade.

Before a trademark’s registration expires, the Registrar is required to notify the trademark owner about the upcoming expiration and the renewal procedures. If the renewal is not completed within the specified timeframe, the Registrar has the authority to remove the trademark from the register. The Act provides a six-month grace period after the expiration date, during which the trademark owner can still renew the trademark by paying a surcharge in addition to the regular renewal fee. If a trademark is removed from the register due to failure to renew, the trademark holder can apply for reinstatement within one year from the registration’s end date. Upon receiving the application and the required fee, the Registrar may reinstate and renew the trademark, possibly with certain conditions or limitations.
